Welcome to Safemaxx Deliv (“Safemaxx Deliv”, “we”, “our”, “us”). 

These Terms of Service (“Terms”, “Terms of Service”) govern your use of our App/Website located at www.safemaxxdeliv.com (together or individually “Service”) operated by Safemaxx Deliv.

Our Privacy Policy also governs your use of our Service and explains how we collect, safeguard and disclose information that results from your use of our web pages.

Your agreement with us includes these Terms and our Privacy Policy (“Agreements”). You acknowledge that you have read and understood Agreements, and agree to be bound by them.

If you do not agree with (or cannot comply with) Agreements, then you may not use the Service, but please let us know by emailing compliance@safemaxxdeliv.com so we can try to find a solution. These Terms apply to all visitors, users, and others who wish to access or use our Services.

This document is an electronic record in terms of the Information Technology Act, 2000 and rules thereunder as applicable and the provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. 

This electronic record is generated by a computer system and does not require any physical or digital signatures. By clicking on the “I ACCEPT” button, You are consenting to be bound by these Delivery Partner T&C for using the SAFEMAXX DELIV Platform for the purpose of receiving orders and delivering the food and beverages to the Users. 

PLEASE ENSURE THAT YOU READ AND UNDERSTAND ALL THESE DELIVERY PARTNER T&C BEFORE YOU USE THE SERVICE OF THE SAFEMAXX DELIV PLATFORM, AS YOU SHALL BE BOUND BY ALL THE DELIVERY PARTNER T&C CONTAINED HEREIN upon clicking on the “I ACCEPT” button. If You do not accept any of the Delivery Partner T&C, please do not use the SAFEMAXX DELIV Platform or avail of any of the services being provided therein. YOUR AGREEMENT TO THE DELIVERY PARTNER T&C SHALL OPERATE AS A BINDING AGREEMENT BETWEEN YOU AND SAFEMAXX DELIV IN RESPECT OF THE SERVICES OF THE SAFEMAXX DELIV PLATFORM.

Your engagement with SAFEMAXX DELIV to use the services of the SAFEMAXX DELIV Platform is subject to your acceptance of these Delivery partners T&C. SAFEMAXX DELIV reserves the right, at its sole discretion, to change, modify, add or remove these Delivery Partner T&C, in part or in whole, at any time, without prior notice to You. It is Your responsibility and duty to check the Delivery Partner T&C periodically for changes. Your continued use of the SAFEMAXX DELIV Platform following the posting of changes will mean that You accept and agree to the changes. As long as You comply with these Delivery Partner T&C, SAFEMAXX DELIV grants You a personal, non-exclusive, non-transferable, limited privilege to enter and use the service on the SAFEMAXX DELIV Platform.

PERSONAL INFORMATION THAT YOU PROVIDE

Personal Information: 

If you want to use our service, you must Sign Up on our Safemaxx Deliv platform such as Site/App. To establish your account, we will ask for personally identifiable information (PII) that can be used to contact or identify you, which may include your name, phone number, e-mail address, or maybe gender. We may also collect demographic information about you, such as your zip code, and allow you to submit additional information that will be part of your profile. Other than the basic information that we need to establish your account, it will be up to you to decide how much information to share as part of your profile. We encourage you to think carefully about the information that you share and we recommend that you guard your identity and your sensitive information. Of course, you can review and revise your profile at any time.

You understand that delivery periods quoted to you at the time of confirming the order are an approximate estimate and may vary. We shall not be responsible for any delay in the delivery of your order due to the delay at the seller/merchant end for order processing or any other unavoidable circumstances.

Your order shall be only delivered to the address designated by you at the time of placing the order on the Platform. Safemaxx Deliv reserves the right to cancel the order, at our sole discretion, in the event of any change to the place of delivery and you shall not be entitled to any refund for the same. Delivery in the event of a change of the delivery location shall be at our sole discretion and reserve the right to charge an additional delivery fee if required.

You shall undertake to provide adequate directions, information, and authorizations to accept delivery. In the event of any failure to accept delivery, failure to deliver within the estimated time due to your failure to provide appropriate instructions or authorizations, then such goods shall be deemed to have been delivered to you and all risk and responsibility in relation to such goods shall pass to you and you shall not be entitled to any refund for the same. Our decision in relation to this shall be final and binding. You understand that our liability ends once your order has been delivered to you.

You might be required to provide your credit or debit card details to the approved payment gateways while making the payment. In this regard, you agree to provide correct and accurate credit/ debit card details to the approved payment gateways for availing of the Services. You shall not use a credit/ debit card that is not lawfully owned by you, i.e. in any transaction, you must use your own credit/ debit card. The information provided by you shall not be utilized or shared with any third party unless required in relation to fraud verifications or by law, regulation, or court order. You shall be solely responsible for the security and confidentiality of your credit/ debit card details. We expressly disclaim all liabilities that may arise as a consequence of any unauthorized use of your credit/ debit card. 

You agree that the Services shall be provided by us only during the working hours of the relevant Merchants.

AMENDMENTS OR MODIFICATIONS IN POLICY

Safemaxx Deliv reserves the right to change or modify these Terms (including our policies which are incorporated into these Terms) at any time by posting changes on the Platform. You are strongly recommended to read these Terms regularly. You will be deemed to have agreed to the amended Terms by your continued use of the Platforms following the date on which the amended Terms are posted.

CONFIDENTIALITY OF USER INFORMATION

Other than for the provision of Delivery Services by the Delivery Partner or Delivery man, SAFEMAXX DELIV does not share any other information of the Delivery Partner with third parties unless requisitioned by (i) government authorities or (ii) the Delivery Partner, whether orally or in writing (via email, SMS, etc.) for any purpose whatsoever, including but not limited to availing loan from financial institutions, filing of tax returns, etc.

Other than for the purpose of undertaking Delivery Services, the Delivery Partner must not disclose any confidential information about SAFEMAXX DELIV, including but not limited to these Delivery Partner T&C, its business strategies, pricing, revenues, expenses, User data, Restaurant Partner data and order information to third parties. 

PAYMENT INFORMATION

Safemaxx Deliv reserves the right to offer additional payment methods and/or remove existing payment methods at any time at its sole discretion. If you choose to pay using an online payment method, the payment shall be processed by our third-party payment Gateway Service provider(s). With your consent, your Credit card / Debit Card payment information will be stored with our third-party payment gateway service provider(s) for future orders. Safemaxx Deliv does not store your credit card/debit card or online net banking payment information. You must ensure that you have sufficient funds on your credit and debit card to fulfill the payment of an Order. Insofar as required, Safemaxx Deliv takes responsibility for payments made on our Platforms including refunds, chargebacks, cancellations, and dispute resolution, provided if reasonable and justifiable and in accordance with these Terms.

Process Flow: 

  • Once a user avails of the services of Online food ordering, Safemaxx Deliv shall be responsible for the safe payment mode on behalf of the User.
  • Safemaxx Deliv uses the payment flow are as follows:
  • User/He/She shall add the food items in the Cart and go for the further check then,
  • Either he/she will choose COD(Cash On Delivery) mode or Choose Online payment mode,
  • If he/she chooses online payment mode then shall be redirected to our backend URL www.safemaxxdeliv.com which is responsible for API and payment options through this channel user can choose a secure payment gateway like Paytm PG or RazorPay for the checkout for order confirmation.

Uses of Cookies

As per the service requirement, Safemaxx Deliv Platform and third parties with whom we partnered may use cookies, Location Geo-tagging, mobile device IDs, web beacons, “flash cookies” and similar files or technologies that use to collect and store information with respect to your use of the Services and third-party websites.

Cookies are small files that are stored on your browser or device by websites, apps, online media, and advertisements. We use cookies and similar technologies for purposes such as:

Authentication of users;

Remembering user preferences and user settings;

Determining the popularity of the content;

Delivering and measuring the effectiveness of advertising campaigns and Offers;

Analyzing site traffic and trends, and generally understanding the online behaviors and interests of people who interact with our services.

We may use third parties, such as Google, to serve ads about our website over the internet. These third parties may use cookies to identify ads that may be relevant to your interest (for example, based on your recent visit to our website), to limit the number of times that you see an advt, and to measure the effectiveness of the ads.

These entities may use cookies, SDKs, web beacons, and other technologies to identify your device when you visit the Safemaxx Deliv Platform and use our Services, as well as when you visit other online sites and services.

USES OF USER’S INFORMATION

We use the information we collect for the following purposes, including

  1. To deliver, customize, strengthen and improve our products and services, such as to enable deliveries and other services, enable features to customize your Safemaxx Deliv account;
  2. To carry out our obligations arising from any agreements entered into between you and us and to deliver you with the relevant data and services;
  3. To assist and enhance the security of our Safemaxx Deliv Platform and for internal processes, including research, troubleshooting, testing, data analysis, statistical and research purposes;
  4. To provide you with data about services we consider similar to those that you are already using, have enquired about, or may involve you. If you are a registered user, we will contact you by electronic means (e-mail or SMS or telephone, or other internet-based instant messaging systems) with information about these services;
  5. To comprehend our users (what they do on our Services, what features they like, how they use them, etc.), improve the content and features of our Services (such as by personalizing content to your interests), process and complete your transactions, make special offers, deliver customer support, operation and respond to your queries;
  6. To produce and review reports and information about, and to conduct research on, our user base and Service usage patterns;
  7. To authorize you to participate in interactive functions of our Services if any, or
  8. To calculate or understand the effectiveness of advertising we deliver to you and others, and to serve relevant advertising to you.
  9. If you are a partner restaurant or merchant or delivery partner or delivery man, to track the progress of delivery or status of an order placed by our customers.
  10. To carry out academic research with academic partners.

We may merge the information that we receive from third parties with the data you give to us and the data we collect about you for the motive set out above.  Further, we may anonymize and/or de-identify information gathered from you through the Services or via other means, including via the use of third-party web analytic tools. As a result, our use and disclosure of bundle and/or de-identified information are not restricted by this Policy, and it may be used and revealed to others without limitation.

We scrutinize the log files of our Safemaxx Deliv Platform that may contain Internet Protocol (IP) addresses, Internet service provider (ISP), browser type and language, referring, app crashes, page viewed and exit websites and applications, operating system, date/time stamp, and clickstream data. This helps us to administer the website, to learn about user actions on the site, to enhance our product and services, and collect demographic data about our user base as a whole.

DISCLOSURE AND DISTRIBUTION OF YOUR INFORMATION

We may share the data that we gather for the following reason:

With Service Providers: We may share your data with our vendors, consultants, marketing partners, research firms, and other service providers or business partners, such as Payment processing companies, to support our business. For example, your data may be shared with outside vendors to send you emails and messages or push notifications to your devices in relation to our Services, to help us analyze and enhance the use of our Services, and to process and gather payments. We also may use vendors for other projects, such as organizing surveys or conducting sweepstakes for us.

With Partner Restaurants/Merchant: While you place a request to order food through the Safemaxx Deliv Platform, your data is provided to us and to the restaurants/merchants with whom you may choose to order. In order to provide your online food order processing, we facilitate your data to that restaurant/merchant in a similar way as if you had made a food order directly with the restaurant. If you provide a mobile phone number, Safemaxx Deliv may send you text messages regarding the order’s delivery status.

With Academic Partners: We may share your data with our academic partners for the reason of carrying out academic research.

With Other Users: If you are a delivery partner, we may share your name, phone number, and/or profile picture (if applicable), and tracking details with other users to furnish them with the Services.

For Crime Prevention or Investigation: We may share this data with governmental agencies or other companies assisting us when we are:

Obligated under the applicable laws or in good faith to respond to court orders and processes; or

Detecting and preventing the actual or potential occurrence of identity theft, fraud, abuse of Services, and other illegal acts;

Responding to claims that an advertisement, posting, or other content violates the intellectual property rights of a third party;

Under a duty to share or disclose your personal information in order to implement our Terms of Use and other agreements, policies or to protect the rights, property, or safety of the Company, our customers, or others, or in the event of a claim or dispute relating to your use of our Services. This includes exchanging data with other companies and organizations for the motive of fraud detection and credit risk limiting.

For Internal Use: We may share your data with any present or future member of our “Group” (as defined below) or affiliates for our internal business purposes The term “Group” means, with respect to any person, any entity that is managed by such person, or any entity that controls such person, or any entity that is under common control with such person, whether directly or indirectly, or, in the case of a natural person, any Relative (as such term is defined in the Companies Act, 1956 and Companies Act, 2013 to the extent applicable) of such person.

With Advertisers and advertising networks: We may work with third parties such as network advertisers to supply advertisements on the Safemaxx Deliv Platform and on third-party websites or other media (e.g., social networking platforms). These third parties may use cookies, JavaScript, web beacons (including clear GIFs), Flash LSOs, and other tracking technologies to measure the efficacy of their ads and to personalize advertising content to you.
While you cannot opt-out of advertising on the Safemaxx Deliv Platform, you may opt out of much interest-based advertising on third-party sites and through third-party ad networks (including DoubleClick Ad Exchange, Facebook Audience Network, and Google AdSense). For more information, visit www.aboutads.info/choices. Opting out means that you will no longer receive personalized ads by third parties ad networks from which you have opted out, which is based on your browsing data across multiple sites and online services. If you change devices or delete cookies, your opt-out may no longer be effective.

To fulfill the purpose for which you provide it.

We may share your data other than as related in this Policy if we inform you and you consent to the sharing.

DATA SECURITY PRECAUTIONS

We have in place suitable technical and security measures to secure the data collected by us.

We use vault and tokenization services from third-party service providers to protect the sensitive personal data provided by you. The third-party service providers with respect to our vault and tokenization services and our payment gateway and payment processing are biddable with the payment card industry standard (generally referred to as PCI-compliant service providers). You are advised not to send your full credit/debit card details through unencrypted electronic platforms. Where we have given you (or where you have chosen) a username and password that enables you to access certain parts of the Safemaxx Deliv Platform, you are responsible for keeping these details confidential. We ask you not to share your password with anyone.

Please be aware that the transmission of data via the Internet is not completely secure. Although we will do our best to protect your personal information, we cannot guarantee the security of your information transmitted through the Safemaxx Deliv Platform. Once we have received your data, we will use strict physical, electronic, and procedural safeguards to try to protect against unauthorized access.

Use of Google Analytics

We may also use Google Analytics or a similar service to collect statistical information about the visitors to this Site and how they use the Site. This, also, is done on an anonymous basis. We will not try to associate anonymous data with your personally identifiable information (PII).

OPT-OUT

When you sign up for an account, you are opting in to receive emails from Safemaxx Deliv. You can log in to manage your email preferences [here] or you can follow the “unsubscribe” direction in commercial email messages, but note that you cannot opt-out of receiving certain administrative notices, service notices, or legal notices from Safemaxx Deliv.

If you wish to draw out your consent for the use and disclosure of your personal data in the manner provided in this Policy or if you want your data to be deleted, please write to us at help@safemaxxdeliv.com, compliance@safemaxxdeliv.com. Please note that we may take time to process such requests, and your request shall take effect no later than 5 (Five) business days from the receipt of such request, after which we will not use your personal data for any processing unless required by us to comply with our legal obligations. We may not be able to offer you any or all Services upon such dropout of your consent.

DISCLAIMER

The platform may be under continuous upgrades, and some functions and features may not be fully operational or available to users as well as restaurant merchants, delivery partners, or Delivery Man. 

SAFEMAXX DELIV does not warrant that You will be able to use the SAFEMAXX DELIV Platform and/ or will be able to provide the Delivery Services at all times or locations on the SAFEMAXX DELIV Platform or that the SAFEMAXX DELIV Platform and the Platform Services will be continuous or flawless or that the defects will be capable of being corrected by the SAFEMAXX DELIV in a timely routine. The Platform Services, SAFEMAXX DELIV Platform, Device, the output generated therefrom, and all other technologies developed by SAFEMAXX DELIV are provided to you on an “AS IS'' and “AS AVAILABLE” basis, and SAFEMAXX DELIV specifically disclaims all warranties and surety, express, implied or statutory, including without limitation any warranty of merchantability, fitness for a particular motive, accuracy, absoluteness, or any other warranty arising from the course of performance or course of dealing.

ANNEXURE A

a) Onboarding Fee: As prescribed by SAFEMAXX DELIV from time to time.

b) Security Deposit: As prescribed by SAFEMAXX DELIV from time to time.

At the time of onboarding, the Delivery Partner shall pay either of 

(i) the Onboarding Fee or

(ii) Security Deposit, at the sole discretion of SAFEMAXX DELIV.

c) Training and Support Fee: As prescribed by SAFEMAXX DELIV from time to time.

d) Delivery Partner hereby acknowledges and agrees that any amount deposited by Delivery Partner to SAFEMAXX DELIV in the form of a Security Deposit shall stand forfeited at the sole discretion of SAFEMAXX DELIV, in the event Delivery Partner does not deliver at least one order pursuant to the Delivery Services under the Agreement for a continuous period of 30 days during the term of the Agreement.

 Shipping Policy

1. Delivery Areas :

  • Service Area: Safemaxx Deliv is putting efforts to make the services reliable and smooth for the customers, we are trying to expand the services in other zones. Unfortunately, if your address is not within our service area, we cannot fulfil your order.
  • Delivery Time Windows: Delivery times may vary based on your location and order volume from the restaurant to the customer’s location.

2. Delivery Fees :

  • Standard Delivery Fee: A standard delivery fee would be applicable on orders as per the location it auto calculated by the Geolocation and applies to all orders.
  • Minimum Order Amount: A minimum order must be applicable as per restaurant instructions shared with us.
  • Delivery Fee Adjustments: Delivery fees may vary based on distance or peak hours. Any additional fees will be communicated at checkout on the basis of distance, in case the wrong location is selected by Customers.

3. Order Processing and Delivery Time :

  • Order Preparation Time: There must be an order preparation time allotted to the restaurants and they have to prepare food items within the time frame provided.
  • Estimated Delivery Time: Safemaxx Deliv has its Estimated Delivery time i.e. 40-60 Minutes if there is no obstacle arises, Once your order is prepared, the estimated delivery time depends on the location shared by the customers. There may be a delay in case of traffic or weather conditions.
  • Tracking: You can track your order in real time in the User app. Notifications will be sent to update you on the status of your delivery.

4. Delivery Handling :

  • Delivery Instructions: Safemaxx Deliv provided clear delivery instructions and ensured that someone was available to accept the order at the specified delivery address.
  • Contact: In case, any issues arise in the delivery, the Safemaxx Deliv partner shall contact you on the customer's mobile number shared in the order.

5. Order Issues and Refunds :

  • Missing or Incorrect Items: If your order is missing items or incorrect, please contact Safemaxx Deliv customer support immediately before receiving your delivery package. We will address the issue promptly.
  • Refunds: Refunds are processed based on the nature of the issue. Your refund will be processed within 4 to 5 business days. Please allow this time for the amount to reflect in your account, depending on your bank or payment provider, refer to our Refund Policy for detailed information in Refund Policy under Terms and Conditions.

6. Special Delivery Requests :

  • Accessibility Needs: If you have specific accessibility needs, please let us know in advance, and we will do our best to accommodate.

7. Changes and Cancellations :

  • Order Changes: Once an order is placed, changes can only be made if the preparation has not started. Contact us immediately to the customer support team to request changes in Order.
  • Order Cancellations: Cancellations can be made within 3 Minutes of placing the order in case the time frame is over then please contact to customer support team for Cancellation or refund if already paid. 
  • In Case, cancellations may not be possible due to food in preparation or an Order is on the way, the customer denies an order to receive then appropriate action would be taken against the Order ID and & the customer. 
  • Safemaxx Deliv continuously trying its best to reduce Food waste and make food for feed. 

8.  Weather and Other Disruptions :

  • Weather Conditions: During severe weather conditions such as heavy rain, earthquakes etc, delivery times may be affected. We will do our best to ensure timely delivery but be aware that delays may occur.

Service Disruptions: In the event of unexpected disruptions (e.g., road closures, emergencies and other unexpected incidents), we will notify you as soon as possible and provide updated delivery information.
